UNICEF is an agency of the United Nations responsible for providing humanitarian and developmental aid to children worldwide. The agency is among the most widespread and recognizable social welfare organizations in the world, with a presence in 192 countries and territories. UNICEF's activities include providing immunizations and disease prevention, administering treatment for children and mothers with HIV, enhancing childhood and maternal nutrition, improving sanitation, promoting education, and providing emergency relief in response to disasters. UNICEF is the successor of the United Nations International Children's Emergency Fund, created on 11 December 1946, in New York, by the U.N. Relief Rehabilitation Administration to provide immediate relief to children and mothers affected by World War II. The same year, the U.N. General Assembly established UNICEF to further institutionalize post-war relief work. In 1950, its mandate was extended to address the long-term needs of children and women, particularly in developing countries. December 11, 1792: The Age Of Enlightenment (The Enlightenment, The Age Of Reason): The Age Of Revolution: The Atlantic Revolutions: The French Revolution: The Trial Of Louis XVI (The Trial Of Citizen Louis Capet, The Trial Of Louis The Last): -- King Louis XVI Of France is put on trial for treason by the National Convention. The trial of Louis XVI was a key event of the French Revolution. It involved the trial of the former French king Louis XVI before the National Convention and led to his execution by guillotine on January 21, 1793. The hearing began on December 3. On December 4, the Convention's president Bertrand Barere presented it with the fatal indictment (drafted by Jean-Baptiste Robert Lindet) and decreed the interrogation of Louis XVI. Louis made his entrance into the Convention chamber then: "Louis", said Barere de Vieuzac, "the nation accuses you, the National Assembly decreed on 3 December that you would be judged by it; on 6 December, it decided that you would be brought to the dock. We shall read you the act giving the offenses with which you are charged...". Controversially, the Convention itself would act as his judge and jury. Because there was no legal precedent or constitutional facility for a legislature to act as a court, the Convention's decision was highly irregular and of doubtful legality. The king's trial began a week later, on December 11th 1792. In the few days available to him Louis assembled a defence team containing some of France's best lawyers: the gifted orator Raymond de Seze; Francois Tronchet, who had interrogated Louis after his arrest at Varennes; and Guillaume Malesherbes, the retired jurist and former minister of state. These men prepared the king's defence thoroughly and delivered it with vigour, in spite of the dangers to their careers and their lives. De Seze, who was given limited time to prepare and had barely slept for four days, delivered a brilliant opening address that focused on the king's inviolability and the Convention's unfitness to judge him: "You want to pronounce on the fate of Louis, yet it is you yourselves who accuse him! You want to pronounce on the fate of Louis, yet you have already declared your views! You want to pronounce on the fate of Louis, yet your opinions are already spread across Europe!" The former king took a close personal interest in his defence. He spent hours each day with his lawyers; their discussions, later described by Malesherbes and Louis' valet Jean-Baptiste Clery, were intelligent and lively. The king had the final say on legal arguments and oversight and approval of all speeches. He would not allow his counsellors to claim he was ignorant of the law, nor would he permit them to invoke pity with emotive language. Under Louis' instructions, his lawyers instead focused on his constitutional inviolability as monarch and the illegality of the trial. Raymond de Seze dissected the charges one by one, skilfully refuting claims that the king was to blame for broken oaths, foreign aggression, emigres, military failures, bloodshed at the Champ de Mars and the Tuileries. But while the deposed king had masterful advocates and brilliant men at his side, he was damned by his own testimony. Louis' utterances in the witness chair, like many of his utterances on the throne, ranged from stubborn and indignant to evasive and vacillating. To claim the inviolability provided by the constitution, Louis had to present as a monarch who trusted the constitution. Given the political climate inside and outside the Convention, it would have taken a masterful performance to save the former king, but his responses under cross-examination were far from masterful. On January 15th 1793, following a short deliberation, the Convention's deputies handed down a unanimous guilty verdict, 693 votes to none. A total of 49 deputies chose to abstain or were absent. The question then turned to the king's fate. Outside the Convention, the gutter press and the Paris sections screamed for his execution. The Jacobins within the Convention also supported the death penalty. The Girondins, however, feared the ramifications of bowing to the Paris crowd and executing the king without a public mandate. Since Christmas 1792, Girondin deputies had been lobbying for an appel au peuple ('appeal to the people') - in effect, a national referendum on whether the king should die. This issue further exposed the gulf between the Paris-centric Jacobins and the nationally-minded Girondins. The fate of the king was eventually concluded on January 17th. It was the Jacobins who won the day, gaining the support of the Plain and defeating the motion for an appel au peuple by 424 votes to 283. The Convention then voted 387 to 334 in favour of executing the former king. A group of 72 deputies raised a supplementary motion urging clemency and a reprieve for the king, but this motion was voted down 380 to 310. March 8, 1869) is #born at his family's home in the commune of La Cote-Saint-Andre in the departement of Isere, in south-eastern France (currently The Musee Hector-Berlioz [The Hector Berlioz Museum]). Berlioz made significant contributions to the modern orchestra with his Treatise on Instrumentation. He specified huge orchestral forces for some of his works, and conducted several concerts with more than 1,000 musicians. He also composed around 50 compositions for voice, piano and orchestra. His influence was critical for the further development of Romanticism, especially in composers like Richard Wagner, Nikolai Rimsky-Korsakov, Franz Liszt, Richard Strauss, and Gustav Mahler. Hector Berlioz died at his house in the Rue de Calais on 8 March 1869, at the age of 65. He is buried in Montmartre Cemetery with his two wives, who were exhumed and re-buried next to him. Fiorello Henry La Guardia's father, Achille La Guardia, was a Catholic native of Cerignola, Apulia, Italy, an Italian immigrant to the United States and a non-practicing Catholic. His mother, Irene Luzzatto Coen, was a Jewish native of Trieste, then part of the Austro-Hungarian Empire, also an immigrant to the United States. His maternal grandmother Fiorina (Luzzatto) Coen was a Luzzatto, a member of the prestigious Italian Jewish family of scholars, kabbalists, and poets. La Guardia's parents met and married in Trieste. Fiorello was raised an Episcopalian and practiced that religion all his life. His middle name "Enrico" was eventually anglicized to "Henry". Fiorello La Guardia was elected to Congress in 1916 and 1918, and again from 1922 through 1930. Irascible, energetic, and charismatic, he craved publicity and is acclaimed as one of the greatest mayors in American history. Only five feet, two inches (1.57 m) tall, he was called "the Little Flower" (Fiorello is Italian for "little flower"). La Guardia, a Republican who appealed across party lines, was very popular in New York during the 1930s. As a New Dealer, he supported President Franklin D. Roosevelt, a Democrat, and in turn Roosevelt heavily funded the city and cut off patronage for La Guardia's enemies. La Guardia revitalized New York City and restored public faith in City Hall. He unified the transit system, directed the building of low-cost public housing, public playgrounds, and parks, constructed airports, reorganized the police force, defeated the powerful Tammany Hall political machine, and reestablished employment on merit in place of patronage jobs. La Guardia was a domineering leader who verged on authoritarian but whose reform politics were carefully tailored to address the sentiments of his diverse constituency. He defeated a corrupt Democratic machine, presided during a depression and a world war, made the city the model for New Deal welfare and public works programs, and championed immigrants and ethnic minorities. He succeeded with the support of a sympathetic president. He secured his place in history as a tough-minded reform mayor who helped clean out corruption, brought in gifted experts, and fixed upon the city a broad sense of responsibility for its own citizens. His administration engaged new groups that had been kept out of the political system, gave New York its modern infrastructure, and raised expectations of new levels of urban possibility. December 11, 1913: #BOTD: #HBD! Buddy Trenier, African American singer of The Treniers (d. March 15, 1999) is #born. The Treniers (pronounced TREY-niers) were an American R & B, jump blues and rock and roll group led by identical twins Cliff and Claude Trenier. They were originally billed as The Trenier Twins, who performed alongside the Gene Gilbeaux Quartet, but shortened their name to The Treniers when Gilbeaux and other musicians became integral members of the group. Besides the Trenier brothers, group members included Don Hill on saxophone, Shifty Henry and later James (Jimmy) Johnson on bass, Henry (Tucker) Green on drums and Gene Gilbeaux on piano. Later, additional Trenier brothers Milt and Buddy, and nephew Skip, joined the group on vocals, and there were many other musician and line-up changes over the years including Herman Washington and Mickey Baker on guitar. The band was based around twins Clifton L. "Cliff" Trenier (July 14, 1919 - March 2, 1983) and Claude Oliver Trenier (July 14, 1919 - November 17, 2003). They were born in Mobile, Alabama, and formed the Alabama State Collegians when in college together in 1939. In 1943, Claude Trenier left to join Jimmie Lunceford's band as lead singer, and Cliff joined him the following year. The twins left the Lunceford band in 1947 and began performing together as the Trenier Twins, backed by the Gene Gilbeaux Quartet which included Gene Gilbeaux on piano and Don Hill on alto sax. They made their first recordings for Mercury Records in 1947, and developed a strong reputation for their live performances. In 1949, they were joined by older brother Buddy Trenier (December 11, 1913 - March 15, 1999), and started to be billed as "The Rockin' Rollin' Treniers". They played a form of music intermediate between swing and early rock and roll. Though their sound is more swing influenced, the Treniers incorporated a thumping backbeat and several songs that included the words "rock" and "roll" - "Rocking on Sunday Night" and "It Rocks! It Rolls! It Swings!", for example, and in the 1940s were already playing "Rockin' Is Our Bizness," which was inspired by Jimmie Lunceford's "Rhythm Is Our Business" from the 1930s. They were also known for the humorous content of many of their songs, and their on stage acrobatics were seen as precursors to the wild antics of many later rock and roll groups. Their lively stage presentation influenced Bill Haley and Comets, The Shadows in the UK in 1959, Paul Revere and Raiders, and beyond. They had their only national chart hit in 1951, when "Go! Go! Go!" reached #10 on the R & B chart, but several of their other records including "It Rocks! It Rolls! It Swings!" (1952) and "Rockin' Is Our Bizness" (1953) "anticipated some crucial elements of rock n roll with their solid, thumping beats, their squealing sax solos." In the 1950s, they moved closer towards an R & B influenced sound, but were unable to weather the influx of rock and roll. Nonetheless the group was considered a strong influence on bands such as their contemporaries Bill Haley and His Comets, and they were one of the first to record Haley's "Rock-a-Beatin' Boogie". Claude Trenier would later claim in an interview in Blue Suede News magazine that his group was responsible for Haley deciding to record rock and roll; this account is disputed. One of the first times rock and roll appeared on national television was in May 1954 when the Treniers appeared on the Colgate Comedy Hour, hosted by Dean Martin and Jerry Lewis. During the playing of their songs, Martin and Lewis participated in the antics, and when the drummer got up and stepped aside, Jerry Lewis sat down and played drums for one song. The group appeared in several films in the 1950s including The Girl Can't Help It and Don't Knock the Rock (which also featured Haley), and continued to perform as recently as 2003. In 1955, the group released the song "Say Hey (The Willie Mays Song)" about Giants center fielder, Willie Mays, which included some dialogue by the Hall-of-Famer himself. The song is included on the soundtrack to Ken Burns 1994 documentary Baseball. Buddy Trenier died at age 85. The location of his death as well as his burial details are not publicly disclosed. August 3, 2008) is #born Aleksandr Isayevich Solzhenitsyn in Kislovodsk, RSFSR (now in Stavropol Krai, Russia). Aleksandr Solzhenitsyn was an outspoken critic of the Soviet Union and Communism and helped to raise global awareness of the Soviet Gulag forced-labor camp system. After serving in the Red Army during World War II, he was sentenced to spend eight years in a labour camp and then internal exile for criticizing Josef Stalin in a private letter. He was allowed to publish only one work in the Soviet Union, the novel One Day in the Life of Ivan Denisovich (1962). Although the reforms brought by Nikita Khrushchev freed him from exile in 1956, the publication of Cancer Ward (1968), August 1914 (1971), and The Gulag Archipelago (1973) angered the Soviet Union authorities, and Solzhenitsyn lost his Soviet citizenship and was exiled in 1974. He was flown to West Germany, and in 1976 he moved with his family to the United States, where he continued to write. In 1990, shortly before the Dissolution Of The Soviet Union, his citizenship was restored, and four years later he returned to Russia, where he remained until his death in 2008. He was awarded the 1970 Nobel Prize in Literature "for the ethical force with which he has pursued the indispensable traditions of Russian literature". His The Gulag Archipelago was a highly influential work that "amounted to a head-on challenge to the Soviet state" and sold tens of millions of copies. Aleksandr Solzhenitsyn died aged 89 in Moscow, SFSR of heart failure. He is buried at Donskoi Monastery Cemetery in Moscow, Russia. She was the first to record Jerry Leiber and Mike Stoller's "Hound Dog" in 1952, later recorded by Elvis Presley, which became her biggest hit, one of the first true rock and roll recordings, staying seven weeks at number one on the Billboard Rhythm & Blues Records chart in 1953 and selling almost two million copies. Thornton's other recordings included the original version of "Ball and Chain", which she wrote, and was famously covered by Janis Joplin. Big Mama Thornton was found dead at age 57 by medical personnel in a Los Angeles boarding house. She died of heart and liver disorders due to her longstanding alcohol abuse. She had lost 355 pounds in a short time as a result of illness, her weight dropping from 450 to 95 pounds. She is buried in Inglewood Park Cemetery in Inglewood, Los Angeles County, California. January 19, 1990) is #born Chandra Mohan Jain in Kuchwada, Bhopal State, British India. During his lifetime, he was viewed as a controversial new religious movement leader and mystic. In the 1960s, he travelled throughout India as a public speaker and was a vocal critic of socialism, arguing that India was not ready for socialism, and that socialism, communism, and anarchism could evolve only when capitalism had reached its maturity. Rajneesh also criticised Mahatma Gandhi and the orthodoxy of mainstream religions. Rajneesh emphasised the importance of meditation, mindfulness, love, celebration, courage, creativity, and humour - qualities that he viewed as being suppressed by adherence to static belief systems, religious tradition, and socialisation. In advocating a more open attitude to human sexuality he caused controversy in India during the late 1960s and became known as "the sex guru". In 1970, Rajneesh spent time in Mumbai initiating followers known as "neo-sannyasins". During this period he expanded his spiritual teachings and commented extensively in discourses on the writings of religious traditions, mystics, bhakti poets, and philosophers from around the world. In 1974, Rajneesh relocated to Pune, where an ashram was established and a variety of therapies, incorporating methods first developed by the Human Potential Movement, were offered to a growing Western following. By the late 1970s, the tension between the ruling Janata Party government of Morarji Desai and the movement led to a curbing of the ashram's development and a back tax claim estimated at 5M USD. In 1981, the Rajneesh movement's efforts refocused on activities in the United States and Rajneesh relocated to a facility known as Rajneeshpuram in Wasco County, Oregon. Almost immediately the movement ran into conflict with county residents and the state government, and a succession of legal battles concerning the ashram's construction and continued development curtailed its success. In 1985, in the wake of a series of serious crimes by his followers, including a mass food poisoning attack with salmonella bacteria and an aborted assassination plot to murder U.S. Attorney Charles H. Turner, Rajneesh alleged that his personal secretary Ma Anand Sheela and her close supporters had been responsible. He was later deported from the United States in accordance with an Alford plea bargain. After his deportation, 21 countries denied him entry. He ultimately returned to India and revived the Pune ashram, where he died in 1990. His remains were cremated, and the ashes were placed in his bedroom in one of the main buildings (LaoTsu House) at his Ashram in Pune, India, now known as OSHO International Meditation Resort. The resort and all associated intellectual property is managed by the registered Osho International Foundation (formerly Rajneesh International Foundation). This official address had been polished by Wingston Churchill and was deliberately moderate in tone. Edward's reign had lasted 327 days, the shortest of any British monarch since the disputed reign of Lady Jane Grey over 380 years earlier. The day following the broadcast he left Britain for Austria. Prince Edward and Simpson were married in France on June 3, 1937 and then lived in Paris. A constitutional crisis in the British Empire arose when King-Emperor Edward VIII proposed to marry Wallis Simpson, an American socialite who was divorced from her first husband and was pursuing a divorce of her second. The marriage was opposed by the governments of the United Kingdom and the Dominions of the British Commonwealth. Religious, legal, political and moral objections were raised. As British monarch, Edward was the nominal head of the Church of England, which did not then allow divorced people to remarry in church if their ex-spouses were still alive. For this reason, it was widely believed that Edward could not marry Simpson and remain on the throne. Simpson was perceived to be politically and socially unsuitable as a prospective queen consort because of her two failed marriages. It was widely assumed by the Establishment that she was driven by love of money or position rather than love for the King. Despite the opposition, Edward declared that he loved Simpson and intended to marry her whether his governments approved or not. The widespread unwillingness to accept Simpson as the King's consort and Edward's refusal to give her up led to his abdication in December 1936. He was succeeded by his brother George VI. Tom Hayden, American social and political activist and politician, author and politician, who was director of The Peace And Justice Resource Center in Los Angeles County, California, best known for his major role as an anti-war, civil rights, and radical intellectual counterculture activist (d. October 23, 2016) is #born Thomas Emmet Hayden in Royal Oak, Michigan. Hayden was for a time the husband of actress Jane Fonda, and was the father of their child, actor Troy Garity. He was a major figure involved in the August 28, 1968 Chicago Police Riot, where around 10,000 protesters were gathered in Grant Park for the demonstration against the Democratic National Convention's proceedings in choosing the pro-war candidate Hubert Humphrey as the party choice for president of the United States. At approximately 3:30 p.m., a young man lowered the American flag that was there. The police broke through the crowd and began beating the young man, while the crowd pelted the police with food, rocks, and chunks of concrete. Tom Hayden, one of the leaders of Students for a Democratic Society, encouraged protesters to move out of the park to ensure that if the police used tear gas on them, it would have to be done throughout the city. The amount of tear gas used to suppress the protesters was so great that it made its way to the Hilton Hotel, where it disturbed Hubert Humphrey while in his shower. The Justice Department meted out charges of conspiracy and incitement to riot in connection with the violence at Chicago. This created the Chicago Eight, consisting of protesters Abbie Hoffman, Tom Hayden, David Dellinger, Rennie Davis, John Froines, Jerry Rubin, Lee Weiner, and Bobby Seale. Demonstrations were held daily during the trial, organized by the National Mobilization Committee to End the War in Vietnam, the Young Lords, and the local Black Panther Party led by Chairman Fred Hampton. In February 1970, five of the remaining seven Chicago Conspiracy defendants (Seale's charges had been separated from the rest) were convicted on the charge of intent to incite a riot while crossing state lines, but none were found guilty of conspiracy. Judge Julius Hoffman sentenced the defendants and their attorneys to unprecedented prison terms ranging from two-and-a-half months to four years for contempt of court. The convictions were eventually reversed on appeal, and the government declined to bring the case to trial again. Tom Hayden died at a hospital in Santa Monica, California, aged 76, after a history of heart problems and declining health in the preceding months. He is buried in Woodlawn Cemetery in Santa Monica, where he was the first interment in "Eternal Meadow," an eco-friendly section. Brenda Lee, American singer and songwriter, is #born Brenda Mae Tarpley in the charity ward of Grady Memorial Hospital in Atlanta, Georgia, to parents Annie Grace (nee Yarbrough) and Reuben Lindsey Tarpley. She weighed 4 pounds 11 ounces at birth. Lee attended grade schools wherever her father found work, primarily between Atlanta and Augusta. Her family was poor. As a child, she shared a bed with her brother and sister in a series of three-room houses without running water. Life centered on her parents finding work, their family, and the Baptist church, where she began singing solos every Sunday. Lee's father was a farmer's son in Georgia's red-clay belt. Standing 5 ft 7 inches, he was an excellent left-handed pitcher and spent 11 years in the United States Army playing baseball. Her mother came from a working class family in Greene County, Georgia. Though her family did not have indoor plumbing until after her father's death, they had a battery-powered table radio that fascinated Brenda as a baby. Both her mother and sister remembered taking her repeatedly to a local candy store before she turned three. One of them would stand her on the counter and she would earn candy or coins for singing. Known professionally as Brenda Lee, she performed rockabilly, pop and country music, and had 47 US chart hits during the 1960s and is ranked fourth in that decade, surpassed only by Elvis Presley, the Beatles and Ray Charles. She is known for her 1960 hit "I'm Sorry", and 1958's "Rockin' Around the Christmas Tree", which has become a Christmas standard. At 4 ft 9 inches tall (approximately 145 cm), she received the nickname "Little Miss Dynamite" in 1957, after recording the song "Dynamite" when she was 12, and was one of the earliest pop stars to have a major contemporary international following. In 1969, Lee returned to the charts with her recording "Johnny One Time" penned by A.L. "Doodle" Owens and Dallas Frazier. King, chief of the CIA's Western Hemisphere Division, sent a confidential memorandum to CIA director Allen W. Dulles. King argued that in Cuba there existed a "far-left dictatorship, which if allowed to remain will encourage similar actions against U.S. holdings in other Latin American countries." This memorandum resulted on March 17, 1960 in U.S. President Dwight D. Eisenhower signing the National Security Council directive that ordered the creation of Operation 40, the code name for the anti-Cuban covert action program conceived by Richard Bissel and presided over by Vice President Richard Nixon, which authorized the CIA to sponsor, organize, train, and equip Cuban refugees and Cuban exiles as a guerrilla and paramilitary force force to overthrow the government of Cuban Prime Minister Fidel Castro and seize control of the Cuban government after what was to become known as The Bay Of Pigs Invasion (April 17-20, 1961). Operation 40 continued to operate unofficially until disbanded in 1970 due to allegations that an aircraft that was carrying cocaine and heroin in support of the group crashed in California. By early 1960, President Eisenhower had begun contemplating ways to remove Castro, in the hopes that he might be replaced by a Cuban government-in-exile, though none existed at the time. On December 11, 1959, following the Cuban Revolution of January 1959, Colonel J.C. King, chief of the CIA's Western Hemisphere Division, sent a confidential memorandum to CIA director Allen W. Dulles. King argued that in Cuba there existed a "far-left dictatorship, which if allowed to remain will encourage similar actions against U.S. holdings in other Latin American countries." This memorandum resulted in the formation of Operation 40. The group that ran Operation 40 was presided over by then-Vice President Richard M. Nixon and included Admiral Arleigh Burke, Livingston Merchant of the State Department, National Security Adviser Gordon Gray, as well as CIA director Allen Dulles. Tracy Barnes, senior staff member at the CIA who served as principal manager CIA operations in the 1954 Guatemalan Coup D'Etat, functioned as operating office of the Cuban Task Force and as principal manager of the The Bay Of Pigs Invasion. Nixon called a meeting on January 18, 1960, in his temporary office near the Lincoln Memorial. Operation 40 was not only involved in sabotage operations. One associate of the group, although never a member, Frank Sturgis, one of the five Watergate burglars whose capture led to the end of the presidency of Richard Nixon, allegedly told author Mike Canfield: "this assassination group (Operation 40) would upon orders, naturally, assassinate either members of the military or the political parties of the foreign country that you were going to infiltrate, and if necessary some of your own members who were suspected of being foreign agents...We were concentrating strictly in Cuba at that particular time." The group sought to incite civil war in Cuba against the government of prime minister Fidel Castro. When Operation 40 failed in accomplishing this goal, then in October 1960, Brigade 2506 was created, a CIA-sponsored group made up of 1,511 Cuban exiles who fought in the April 1961 Bay of Pigs Invasion. On April 17, 1961, Vicente Leon Leon, with other members of Operation 40, landed at the Bay of Pigs via the CIA-chartered freighter Atlantico, and was killed in action. Operation 40 is a playable faction in the video game Call Of Duty: Black Ops. Within the game's campaign mode, there is heavy implication that the main protagonist and Operation 40 operative Alex Mason may have been involved in the assassination of President Kennedy as a Soviet sleeper agent. Louisiana: -- The United States Supreme Court rules unanimously in Garner v. Louisiana, 368 U.S. 157 (1961), a landmark civil rights case argued before the court by Thurgood Marshall, that Louisiana could not convict peaceful sit-in protesters who refused to leave dining establishments under the state's "disturbing the peace" laws. African-American students from Southern University sat at a whites-only segregated lunch bar at Sitman's Drugstore in Baton Rouge, Louisiana. The management summoned the police after the students quietly remained despite being asked to relocate to another counter. After ordering the black patrons to leave, the police arrested them, charged them with disturbing the peace, and claimed that their behavior could "foreseeably disturb or alarm the public," according to the state's "disturbing the peace" statute. The National Association for the Advancement of Colored People defended the student demonstrators, and the Kennedy administration's Justice Department filed a legal brief on their behalf. In a 9-0 decision, the Supreme Court ruled in the African-American students' favor, agreeing that the state had violated due process of law under the Fourteenth amendment, and found no evidence that the students' behavior could have foreseeably disturbed the peace. In his written opinion, Justice John Marshall Harlan likened sit-in demonstrations to verbal expression as a form of free speech. Justice William O. Douglas's concurring opinion stated, "For the police are supposed to be on the side of the Constitution, not on the side of discrimination. Yet if all constitutional questions are to be put aside and the problem treated merely in terms of disturbing the peace, I would have difficulty in reversing these judgments. I think, however, the constitutional questions must be reached and that they make reversal necessary." Garner v. Louisiana was an important case for the Civil Rights Movement, and one of many civil rights cases argued before the Warren Court (1953-69). Launched on December 7, 1972 at 05:33:00 UTC (12:33 a.m. EST) from the Kennedy Space Center Launch Complex 39A (LC-39A), with a crew made up of Commander Eugene Cernan, Command Module Pilot Ronald Evans, and Lunar Module Pilot Harrison Schmitt, it was the last use of Apollo hardware for its original purpose; after Apollo 17, extra Apollo spacecraft were used in the Skylab and Apollo-Soyuz programs. Apollo 17 was the first night launch of a U.S. human spaceflight and the final manned launch of a Saturn V rocket. It included three days on the lunar surface, extended scientific capability, and the third Lunar Roving Vehicle (LRV). While Evans remained in lunar orbit in the Command/Service Module (CSM), Cernan and Schmitt spent just over three days on the moon in the Taurus-Littrow valley and completed three moonwalks, taking lunar samples and deploying scientific instruments. The landing site was chosen with the primary objectives of Apollo 17 in mind: to sample lunar highland material older than the impact that formed Mare Imbrium, and investigate the possibility of relatively new volcanic activity in the same area. Cernan, Evans and Schmitt returned to Earth on December 19 after a 12-day mission. Apollo 17 is the most recent manned Moon landing and was the last time humans travelled beyond low Earth orbit. The battle was fought at Magersfontein, near Kimberley, South Africa, on the borders of the Cape Colony and the independent republic of the Orange Free State. British forces under Lieutenant General Lord Methuen were advancing north along the railway line from the Cape to relieve the siege of Kimberley, but their path was blocked at Magersfontein by a Boer force that was entrenched in the surrounding hills. The British had already fought a series of battles with the Boers, most recently at Modder River, where the advance was temporarily halted. Lord Methuen failed to perform adequate reconnaissance in preparation for the impending battle and was unaware that Boer Vecht-generaal (Combat General) De la Rey had entrenched his forces at the foot of the hills, rather than the forward slopes, as was the accepted practice. That allowed the Boers to survive the initial British artillery bombardment, and when the British troops failed to deploy from a compact formation during their advance, the defenders inflicted heavy casualties.
